A U.S. Border Patrol agent who was struck by a suspected drunk driver after he stopped to help an injured motorcyclist had his medical condition upgraded Monday from fair to good, a hospital spokeswoman said, and the name of the dead motorcyclist was released.

Agent Raul Arriola was improving at UC San Diego Medical Center, where he was admitted early Sunday after the accident on Interstate 5 in Chula Vista, a hospital spokeswoman said.

The 33-year-old motorcyclist Arriola had stopped to help was identified Monday by the county medical examiner’s office as Herbert O’Neil Lee, 33, a warehouse worker who lived in the 2200 block of Isabel Street.

Lee had lost control of his motorcycle at 1:38 a.m. Sunday and crashed into the center divider just south of the Palomar Street overpass, officers said.

Paul Stuhler, 23, of Chula Vista, allegedly struck the motorcycle, ran over Lee and hit Arriola, authorities said.

Stuhler was being held Monday on $35,000 bail at the County Jail in Chula Vista on suspicion of drunk driving and vehicular manslaughter, a jail spokeswoman said.
