Policeman in Rape Case Gets Fired : Investigation: The termination stems in part from 1 of 3 charges involving alleged sexual attacks.

A San Clemente police officer accused of raping a woman and sexually assaulting two others has been fired for violating department regulations, officials said Saturday.

David Wayne Bryan, 32, who has pleaded innocent to the rape and assault charges, was fired June 7 after a department investigation, said San Clemente Police Chief Albert C. Ehlow.

“After consulting with the city attorney, we terminated Mr. Bryan due to violations of rules and regulations of the department,” Ehlow said.

Ehlow would not discuss specifics of the investigation or the violations that Bryan is accused of breaching. He said some of the alleged violations stemmed from the criminal complaint and that others were unrelated. He also said the investigation focused on Bryan and that no other officers have been disciplined.

Bryan was placed on administrative leave after a Jan. 30 complaint by a woman who said she had gone to Bryan’s San Clemente home after a date and was raped.

Two other women came forward after reading newspaper accounts about an unnamed San Clemente police officer under investigation for rape, and reported that Bryan had also assaulted them, according to prosecutors.

Neither Bryan nor his attorney could be reached for comment Saturday. Ehlow said Bryan has indicated that he will appeal the firing but has asked that a hearing be deferred until after the criminal trial is over.

Bryan, a four-year veteran of the force, is charged with nine felony counts and four misdemeanors. The counts include rape, sexual battery and assault and battery by an officer.

Prosecutors allege that Bryan attacked one woman last Jan. 27, and that the “date rape” occurred two days later.

Prosecutors have also accused Bryan in a 1989 assault that they say occurred while he was in uniform and on duty.
