NEWPORT BEACH : Restaurant Review Scheduled Today

A proposed expansion of a fast-food restaurant on Balboa Island will be discussed by the Planning Commission today in a review of the business’s operations.

Island Yogurt Works, a takeout frozen yogurt shop at 322-A Marine Ave., won Planning Commission approval earlier this year to expand operations to include sales of other foods, including hot dogs, sandwiches and pizza, on the condition that a review of the business at the end of the summer season proved it was in compliance with city operating code.

Neighbors objected that patrons of the restaurant used a nearby alley for parking, and that the shop was staying open beyond its scheduled 10 p.m. closing time.

The planning staff expressed concerns that the addition of countertops and stools changed the takeout nature of the business, but noted in the staff report to the commission that some of the fixtures have been removed.

The review of the restaurant will show findings of code-enforcement officials and whether the restaurant has adhered to the conditions set out in its use permit, such as keeping customers out of the alley and closing the store’s doors on time.

The Planning Commission may decide to continue monitoring the business, or it could begin revocation proceedings if members find that the business is not operating according to code.
