Boy, 5, Is Struck by Truck, Killed : Fatality: Brian Marek skated out of his family’s driveway and into the street. The driver is not cited.

A 5 year-old Mission Viejo boy was killed Monday as he sped on in-line skates out of his family’s driveway and into the path of a truck, authorities and neighbors said.

Brian Marek was struck and killed about 3:15 p.m. after being dragged several feet by a Chevy Blazer, Orange County Sheriff’s Lt. Jay Mendez said. The 17-year-old driver may not have seen Brian until it was too late, Mendez said.

Brian died at the scene from head and chest injuries, authorities said.

The driver was not cited. Sheriff’s deputies have impounded the vehicle and will conduct more interviews as part of a continuing investigation, Mendez said.

Brian skated into the street from his home on Novia Circle and was either not able to stop or did not see the truck, neighbors said.

“The guy was driving down the street, not doing anything wrong,” said an 18-year-old neighbor. “The guy probably did not see him because (Brian) was going too fast.” The neighbor, who would identify himself only as Jeff, said his girlfriend ran to call 911 as he went to the boy.

Brian “died about one minute later, but he was never conscious,” he said.

Neighbors identified Brian’s parents as Esther Marek and U.S. Marine Corps Capt. Mark Marek, based at El Toro.

Neighbors described their street, a short two-lane road that juts north from Amurro Drive, as quiet.

“You move to a cul-de-sac to try to avoid this,” one neighbor said in reference to the accident.

“This is a cul-de-sac, and we don’t get much traffic, but we’re scared to death of kids in the road because there is such little traffic that they may not pay attention” when a car does come along, neighbor Terry Dasno said.
