A San Diego man was sentenced to life in prison without the possibility of parole in an unusual murder case in which he was convicted of killing the fetus of a woman he wounded during a robbery.

Robert Anthony Davis, 21, was convicted of first-degree murder Dec. 6. The jury also found that the murder was committed during a robbery, making Davis eligible for the life sentence.

Superior Court Judge Michael Wellington also sentenced Davis on Tuesday to an extra five years in state prison because he used a gun during the attack.

Defense attorney Jeffrey Thoma has said he will appeal.

Maria Trinidad Flores, 21, was wounded March 1 by a gunshot in her chest after a struggle with Davis near a check-cashing store in the 5100 block of Imperial Avenue. Davis fled with $387 that Flores had obtained by cashing a welfare check.

After five hours of surgery, Flores’ child was stillborn.

According to an autopsy, the fetus was not struck by the bullet, but died from the shock and loss of blood experienced by Flores.
