Yours <i> Old? </i> Ours Are <i> Decrepit--</i> So There!
A federal judge in Los Angeles will decide who can lay claim to having the “best oldies on the radio.”
KCBS-FM (93.1), which says it owns that on-air slogan, has asked U.S. District Judge Dickran Tevrizian to order KRTH-FM (101.1) to stop using it.
KRTH says who’s best is a matter of opinion.
“This is not trademark infringement,” KRTH attorney Dorothy Wolpert said. “It’s not Kleenex, Cellophane or Coca-Cola. It’s a simple English sentence: ‘We’re the best.’ Everybody says that.”
Tevrizian on Thursday denied KCBS-FM’s request for a temporary restraining order against KRTH using the slogan. He set a hearing on the matter for Feb. 24.
