LOS ANGELES : Charges Against Deputy, LAPD Officer Reinstated

A federal judge reinstated three corruption charges against a sheriff’s deputy and a police officer, but dismissed another charge against the deputy, prosecutors announced Wednesday.

U.S. District Judge Robert Takasugi filed an amended order reversing his oral decision to throw out conspiracy and false arrest charges against Deputy Robert Tolmaire, and false arrest and false testimony charges against Los Angeles Police Officer Stephen Polak.

Takasugi based his earlier decision on the votes of jurors who deadlocked on 14 charges against the officers on March 5. But the vote count he read in court this week differed from the count he read March 5. “After re-examination of the jury’s written numerical count, the court amends its order. . . .” his latest order states.

The officers were among six former members of a narcotics unit charged with beating up and stealing from suspects they investigated from 1985 to 1988.
