POMONA : Mistrial for Mother Accused of Infant’s Murder
A mistrial was declared Friday in the murder trial of Linda Philhower, a 23-year-old Azusa child-care worker accused of killing her newborn baby in her mother’s home.
A Pomona Superior Court jury found Philhower not guilty of first-degree murder but could not reach a verdict on second-degree murder or involuntary manslaughter. A retrial was set for May 11. Deputy Dist. Atty. Hyatt Seligman said he will prosecute again.
Philhower, a single woman who lived at home with her mother and stepfather, concealed her pregnancy and gave birth to an eight-pound boy at home in her bathroom on Dec. 29, 1990. She placed the baby in a towel and put him inside a dresser, where his body was found 11 days later.
