San Diego : Suspended Attorney Gets 1-Year Sentence

A suspended attorney who continued to represent clients was sentenced Friday to one year in County Jail.

Richard Norman Potack, 41, was also ordered to repay $3,450 to his former clients, whom he represented in civil and criminal matters without authorization.

Potack pleaded guilty March 27 to two counts of illegally practicing law. He was suspended by the State Bar for four years last August, but the reason for the suspension has not been made public.

He continued to practice law and used his 1979 Cadillac as a mobile office while meeting prospective clients in restaurants. He was arrested March 11 in Hillcrest by a district attorney investigator who posed as a client.

Potack could have received a maximum sentence of three years, eight months in state prison and a $20,000 fine. He resigned from the state bar and relinquished any right to practice law after his guilty plea.
