SAN JUAN CAPISTRANO : Murder-Solicitation Defendant Is Sued

A local businessman accused of hiring a man to kill his secretary’s boyfriend was sued Friday by the secretary and her boyfriend.

Cynthia Asher and Wilbur Constable filed suit in Orange County Superior Court against Julius F. Schill, seeking unspecified damages for assault and battery, conspiracy, emotional distress and sexual harassment.

The suit comes three days before Schill goes to trial for allegedly arranging the murder attempt.

Federal prosecutors alleged that Schill hired co-defendant Richard M. Dota--a reputed member of the Genovese organized crime family--to kill Constable because he wanted to pursue a relationship with Asher.

According to prosecutors, Dota then hired a three-man “hit crew” to kill Constable. On Oct. 11, 1991, the three men apparently lured Constable to a dark parking lot in Irvine and beat him with bats, shot him in the back of the head and left him for dead.

Miraculously, Constable survived.

In the lawsuit, Constable claims that he suffered permanent physical and mental damage in the attack.

Asher claims that Schill, who was her boss, sexually harassed her while on the job “in an effort to obtain companionship and sexual favors” from her.
