SAN DIEGO : Gunman Guilty of 2nd-Degree Murder
A man who shot into a Paradise Hills duplex after a drug-related dispute and killed a 13-year-old girl talking on the phone was found guilty Monday of second-degree murder.
Michael Hansen, a 25-year-old San Diego man, was convicted after a week of jury deliberations of killing Diane Rosalez, an eighth-grade student at Granger Junior High School.
According to testimony at his trial, Hansen fired 11 rounds from a 9-millimeter handgun into the home in the 5600 block of Albemarle Street on Sept. 19. The target in the attack was a roommate who had apparently stolen some drugs from Hansen and his associates.
Hansen was found not guilty of attempted murder for shooting at Rosalez’s 5-year-old brother, who was nearby at the time of the shooting and escaped without injury.
Defense attorney Kay Sunday argued to the jury that her client was, at most, responsible for involuntary manslaughter because Hansen was brain damaged from several accidents and was intoxicated at the time of the shooting.
Hansen could be sentenced to 15 years to life in state prison when he appears before Superior Court Judge Bernard Revak on Aug. 10.
