Former MGM Chairman Giancarlo Parretti, who lost control of the movie company in a bitter court fight last year, was indicted on two felony counts by a Delaware grand jury on Tuesday.

The indictment charges that Parretti tampered with physical evidence and perjured himself in the course of the Delaware trial. There was no word on whether the Delaware attorney general’s office, which brought the charges, would seek to extradite Parretti from Italy.

The Italian financier was forced to surrender control of MGM to his bankers, France’s Credit Lyonnais, after defaulting on loan payments. In the past, he has pledged to regain control of the company. Parretti, however, could not be reached for comment on Tuesday.

The indictment pertains to documents entered into evidence by Parretti during the Delaware trial in which Credit Lyonnais gained control of the company.

The grand jury charged that the documents, which had to do with a corporate governance agreement at MGM, constituted “false physical evidence.” Parretti is also accused of lying when he was questioned about the documents under oath.

Parretti’s Pathe Communications Corp., part of an international business empire, purchased MGM for $1.3 billion in 1990, with plans to revive the struggling company that was once Hollywood’s top movie studio. But within months Parretti’s plans started to crumble, as he fell behind on loan payments to Credit Lyonnais.
