3 Indicted in Man’s Kidnaping, Murder

Three men were indicted Wednesday for the kidnaping and murder of a 23-year-old Anaheim man who was seized from behind the wheel of his car in front of his home.

Police found the body of Joseph Andrew Kondrath in the trunk of his car on June 10 on the 2000 block of West Crescent Avenue, about three-fourths of a mile from his house. He had been shot in the head and his wallet was missing.

The Orange County Grand Jury returned murder, robbery and kidnaping indictments against Shawn Burney, 18; Allen Dean Burnett, 18, and Scott Rembert, 20. Their residences were not available. Each is also charged with two special circumstances--murder in the course of a robbery and murder in the course of a kidnaping--either of which could send them to the gas chamber. In addition, all are charged with the use of a gun in the commission of the crimes.

The district attorney’s office has not yet decided whether it will ask for the death penalty. The three men are being held in Orange County jail without bail, pending arraignment.
