Woman Held in Slaying of Ex-Husband : Shooting: Police say couple’s children watched as shot was fired after their father smashed his fists through car window.

As her two children watched, a woman allegedly shot and killed her ex-husband after he threatened her and punched out her car window, police said Sunday.

James Allen Burgin, 34, of Corona died of a single gunshot about 1:20 p.m., during what was supposed to be a visitation exchange of the couple’s sons, Sgt. Perry Miller said. The shooting occurred in the 200 block of Vallejo Street.

Miller said Burgin’s ex-wife, Annette Burgin, 32, of Rancho Cucamonga, was arrested and taken into custody about half a block away from the shooting scene after she drove into the driveway of a stranger’s home and said, “Can you please call police? I think I just shot somebody.”

Annette Burgin had custody of the boys, ages 3 and 6, and was bringing them for a visit with their father at his sister’s home, Miller said.

As his ex-wife pulled up, neighbors said, James Burgin crawled from some nearby bushes to her car and began throwing objects at the window.

Miller said the man then punched out a passenger-side window with his fists.

His ex-wife allegedly then pulled a gun and shot him from inside the car, Miller said.

Police found Burgin on the doorstep of his sister’s home, where he was pronounced dead.

After the shooting, Annette Burgin drove off with her children still inside the car, Miller said. She had gone only a short distance when “she apparently saw some people in the front yard and advised them to go call police. She told them she had just shot somebody,” Miller said.

He said Annette Burgin apparently had been concerned about her ex-husband’s actions in the past and had gotten a restraining order that prohibited him from making contact with her.

“There were several domestic violence reports taken concerning this couple in Riverside County. This thing was ongoing.”

“We don’t have a copy of the divorce, but we do know that he was not supposed to be there,” Miller said.

Police are investigating where the gun was obtained and whether it was registered.

James Burgin’s sister told a reporter that she did not wish to comment about the shooting.

Annette Burgin remained in custody Sunday night, and police said they planned to charge her with murder, pending review by the Orange County district attorney’s office, Miller said.
