CALABASAS : Council to Discuss Land-Use Rules
The Calabasas City Council tonight will discuss amending land-use rules to clear the way for a controversial housing project in the Las Virgenes Valley.
Micor Ventures had city approval to build 250 luxury homes east of Las Virgenes Road, but those plans were scotched in December when Los Angeles Superior Court Judge John O’Brien ruled that the city erred.
O’Brien said that since Calabasas, which incorporated in 1991, does not have its own land-use plan, it must abide by Los Angeles County’s, which would not have allowed the project.
The ruling stemmed from a lawsuit filed by the environmental group Save Open Space.
Tonight’s action is a procedural tactic to protect against future lawsuits by including in the city’s land-use ordinances language that states decisions by the Calabasas council supersede previous county rules. If the council adopts the changes, Micor would be allowed to submit its proposal again.
