LOS ANGELES : Woman’s Suit Against City for Riot Injuries Dismissed
A lawsuit filed by a woman against the city over injuries suffered in last year’s riots has been dismissed by a Los Angeles Superior Court judge.
At least four other similar suits have been dismissed because of state codes saying that government is not required to provide protection for citizens. Soon Ja Kim’s suit argued that Los Angeles police breached that immunity when officers promised to help her after she was shot, but then left her in a parking lot. Judge Dion Morrow upheld the city’s position that it was immune.
Kim’s attorney, John Adsit, said he is considering an appeal to find out: “Aren’t they accountable under any circumstances?”
Last month, a Los Angeles Superior Court judge gave Reginald O. Denny and two other riot victims a chance to redraft their lawsuits against the city in order to amend the civil rights allegations in their complaints. “The question of whether governmental immunities generally available should be applied in a civil rights cause of action has not been addressed by California appellate courts,” Judge John Leahy said.
