Simpson Murder Case : CASE LAW

In denying a defense motion to suppress evidence, Judge Kathleen Kennedy-Powell cited a 1989 ruling. The case involved an elderly woman who was assaulted in Merced County. While questioning the woman, two sheriff’s deputies heard music through the wall of the adjoining apartment. Believing another victim might be inside, they entered through the unlocked door and found Dale Vernon Cain drunk and asleep on the floor. His clothes fit the woman’s description, and bloodstains matched her blood type. After a judge ruled the entry was legal, Cain pleaded no contest to attempted rape.

Robert H. Philibosian and Ira Reiner, two of the many lawyers serving as media commentators on the Simpson case, are familiar with the pressures of prosecuting high-profile cases in Los Angeles. Both are former Los Angeles district attorneys. Philibosian’s cases included prosecution of Angelo Buono for the Hillside Strangler slayings of 10 young women and girls. Reiner oversaw such trials as the McMartin Pre-School molestation case and the Richard Ramirez Night Stalker murder case. Reiner is serving as a consultant for NBC News; Philibosian has been interviewed on a variety of programs.
