Shopping Center Decision Appealed
Two months after a suit to block the construction of the 829,000-square-foot Valencia MarketPlace was rejected, a citizens’ group that endorses slow-growth policies announced Thursday it will appeal a decision of a Los Angeles Superior Court judge.
“We have filed an intent to appeal,” said Lynne Plambeck, vice president of the group, which is among the chief opponents of the proposed construction of what would be the largest shopping complex in the Santa Clarita Valley.
The lawsuit, filed by the Santa Clarita Organization for Planning the Environment, alleged that the Board of Supervisors did not hold the developers to county guidelines.
The group charges that at least 100 oak trees would be cut down during the construction and that a creek would be filled and diverted into a pipeline, disturbing the natural habitat.
But in March, Judge Diane Wayne ruled in favor of the defendant. She said the project was in conformity with the county’s General Plan.
