The eldest of three teen-agers charged with the fatal shooting of Glendora Police Officer Louis Pompei during a store robbery pleaded not guilty Wednesday in Pomona Superior Court.

Prosecutors said they had not ruled out seeking the death penalty.

Daniel Hernandez, 19, of Rosemead was charged with murder and assault with a deadly weapon in the June 9 shooting death of Pompei during the robbery of a San Dimas Vons supermarket.

Pompei, who was off duty and shopping, witnessed the robbery and tried to stop it.

Deputy Dist. Atty. Mark Arnold said prosecutors filed special circumstances allegations against Hernandez for killing a peace officer and committing a murder during a felony.

Arnold said prosecutors hope to try both of Hernandez’s younger accomplices as adults. A hearing is set for July 6.

Hernandez’s younger brother, Larry, 16, and Robert Ramirez, 17, of San Gabriel, pleaded innocent to charges of murder in Juvenile Court last week.
