San Gabriel Valley : Bid for Recount in Council Race Delayed

Diamond Bar City Council candidate Don Schad might have to wait another month to see if he won a seat in November’s election.

A Los Angeles Superior Court judge Friday set a hearing for Jan. 18 on a challenge by Schad to a vote recount that left him and opponent Carol Herrera in a dead heat.

Judge Robert O’Brien ordered Schad to show cause at that hearing why the election result--a deadlock of 1,609 votes each--should not stand.

“This means the judge will review the three ballots we’re challenging,” said Al Perez, Schad’s attorney.

But Fred Woocher, Herrera’s attorney, said the judge has not issued the injunction requested by Schad that would stop the council from deciding the race with a lottery or a special runoff election in March. Herrera favors a runoff.

The council has indicated it also favors a runoff and could decide the issue Tuesday.
