Homeowners Group Is Awarded Legal Fees

A South Laguna homeowners group that filed a lawsuit to block the city-approved Binion housing development has been awarded $50,000 in attorneys’ fees by a Superior Court judge.

Las Vegas casino owner Jack Binion, the project’s developer, is responsible for paying the award, officials said.

The City Council approved the 22-home project in November, but the South Laguna Civic Assn., whose homes lie beneath the hilltop development, sued to overturn the city’s approval, saying that the development would violate environmental and coastal view laws.

In June, Orange County Superior Court Judge William F. McDonald told Laguna Niguel officials that the project would be visible from Coast Highway and thus would require a Local Coastal Plan amendment.

City officials returned to court with the amendment last month. A final decision on the case is expected within 30 days.
