Firm Sued by Wonderware Files a Similar Lawsuit

A suburban Detroit company sued by Wonderware Corp. last fall over copyright infringement has filed a similar lawsuit claiming that the Irvine software maker unlawfully used its technology.

Cyberlogic Technologies Inc. in Troy, Mich., asserted in its lawsuit filed in federal court in Detroit that Wonderware infringed on a Windows NT technology that Cyberlogic developed and copyrighted. Cyberlogic, which seeks an injunction along with actual and punitive damages, contends that Wonderware has earned at least $40 million from its alleged infringement.

“This is their response to our suit against them,” said Tammy Trenkmann, a Wonderware spokeswoman. “They’re making the same allegations we made against them.”

In October, Wonderware sued Cyberlogic in federal court in Santa Ana, accusing the Michigan company of misappropriating trade secrets and infringing on the Windows NT technology. Wonderware said Cyberlogic developed the software under contract for Wonderware, which makes software for industrial automation.

Wonderware, which also seeks an injunction and actual and punitive damages, also had named Intellution Inc. in Norwood, Mass., as a defendant.
