City OKs New Zoning for Adult Businesses

In a 5 to 2 vote, the City Council on Monday approved a revised ordinance that regulates where sex-oriented business may operate.

Mayor Shirley S. Dettloff and Councilman Ralph H. Bauer voted against the measure, saying they wanted tougher restrictions.

Under the revisions, nude dance clubs and other adult businesses will be restricted to industrial areas instead of commercially zoned areas.

The ordinance requires 750 feet between adult businesses, and allows for a small business sign that would be visible from a nearby street. It also requires property owners within 1,000 feet of a proposed adult business to be notified when an application is made to the Planning Commission.

An attorney for a business seeking to open an erotic dance club on Beach Boulevard argued that the revisions left the city open to lawsuits. But the city attorney’s office told the council the ordinance was fully defensible in court.
