Mother Who Darted Into Street Won’t Be Charged in Child’s Death
A West Hills mother who ran in front of a truck with her baby in a stroller will not be prosecuted for the child’s death, the prosecutor handling the case said Thursday.
Although police concluded that Maria Elena Gazarez De Garcia, 31, was negligent in the March 26 accident, Deputy Dist. Atty. Larry Diamond said she did not deserve to face criminal penalties.
“I just thought it wouldn’t be nice,” he said. “In considering all the circumstances, it didn’t appear the interests of justice would be served by prosecuting her.”
Garcia had been pushing the stroller containing her 1-year-old daughter while walking with her older daughter on Roscoe Boulevard at about 3:20 p.m. on March 26, police said. When they reached Topanga Canyon Boulevard, they darted into the street and all three were hit by the truck turning into the intersection.
