Lucky Warehouse Workers File Age Bias Suit

Seventy-two Lucky Stores workers over the age of 40 are suing to stop the chain from transferring them from a recently closed Fullerton warehouse to warehouses in Irvine and Buena Park. The suit, filed in Santa Ana Superior Court, does not list any dollar damages. The employees allege that they would lose their seniority and be forced to accept jobs that are too physically demanding. The suit also claimed the employees could maintain their seniority and job rank if they were transferred to a nearby La Habra warehouse. Dublin-based Lucky rejected that reassignment plan because it wanted to hire younger workers at lower wages and benefit levels, the suit claims. Lucky denied the allegations, saying the warehouse closing and transfers were negotiated with the Teamsters, the union representing the workers.
