An Anaheim man is accused of trying to smuggle a Mexican boy into the United States for sexual purposes, a federal prosecutor said Friday.

Timothy Martin Waite, 23, was charged in a five-count indictment with attempting to bring the boy, between the ages of 9 and 13, into the country from the Calexico port of entry on Nov. 21.

Prosecutors contend that Waite had unlawful sexual conduct with the boy while visiting Mexicali, Mexico. He then tried to bring the boy into the country by giving immigration inspectors a fraudulent birth certificate, claiming the boy was a U.S. citizen, prosecutors said.

Waite was arrested at his Anaheim home on Dec. 31. He was jailed without bail after a U.S. magistrate found he was a danger to the community. His arraignment was scheduled for Tuesday.

If convicted on all counts, Waite faces a maximum 40 years in federal prison and more than $1 million in fines.
