A Superior Court judge has delayed action for 60 days on a civil suit the Lake Mission Viejo Assn. filed against the city over a new law that preserves public views.

Jeff Miklaus, treasurer for the Lake Mission Viejo Assn., said Superior Court Judge William McDonald granted the extension Tuesday after attorneys for both the city and the association stated they were not prepared to move forward.

The association filed the lawsuit against the city July 1 to challenge an ordinance restricting the height of landscaping on an 800-foot stretch of association property bordering Alicia Parkway.

The suit alleges that the law is discriminatory because it applies only to land owned by the association.

Attorneys for each side will meet with McDonald on Feb. 22 to determine the next step.
