A freelance photojournalist faces five counts of interfering with Irvine police while videotaping traffic accidents.

David S. Harvey, 45, a Tustin-based television reporter, is scheduled to go on trial at the Harbor Justice Center in Newport Beach on Tuesday.

Harvey’s company, Media Partners TV, issued a written statement Tuesday alleging that the charges were made in retaliation for a $1.1-million claim Harvey filed against the city in August.

In the claim, Harvey alleged assault, battery, interference with business and occupation, malicious prosecution, conspiracy and harassment. He is seeking compensation for physical injury, emotional distress and interference to his job.

According to the claim, Harvey was assaulted by Irvine police, who deliberately shoved his camera into his eyes while he was filming a fatal accident on Alton Parkway in March.

While police officials declined to comment on the matter because of the upcoming trial, an earlier statement said Harvey had been warned not to interfere with police work. After complying with the request and retreating from the scene, he moved forward again, according to the statement made by Lt. Sam Allevato.

Harvey denied the charges and said his video showed that he did not cross police lines at any point.
