Officials received notice of intent to sue last week from homeowners Ralph and Linda Zehner over the city’s denial of their plans to build two rental duplexes and a six-car garage behind their East Culver Avenue home. The Zehners are seeking a legal remedy to construct the units, as well as attorney fees and possible damages.

The number of proposed units meets zoning requirements, City Atty. David DeBerry said, but the development is too big and would negatively affect the Old Towne neighborhood. He added that the suit could be decided in about a year. The Zehners began working to seek city permits to build their rental complex in May 1997.

Also last week, the City Council accepted Linda Zehner’s resignation from her appointed position on a city committee.
