Three residents will soon decide whether to file a lawsuit against the City Council for allegedly violating the state’s open meeting law. Brad Morton, Eugene Dale Tyler and Kyle Crenshaw allege that the council committed five violations of the Brown Act in a closed session April 19, including discussing an item not protected by the act and not listing the item on the meeting’s agenda.

The city has 30 days to respond, but Mayor Sherri M. Butterfield said the council is on vacation and will not be meeting until Aug. 16--10 days past the deadline. “I don’t think it’s something we need to take care of right now, but we will when we reconvene,” she said. “It’s not that we’ve made any decisions. . . . We simply haven’t had the opportunity.”

The residents have to file any suit within 15 days after the 30-day deadline.
