One of the authors of an initiative to temporarily halt development in the city said he intends to appeal an Aug. 7 court ruling that invalidated the measure.

Albert Filger, who spearheaded the Residential Building Permit Moratorium Initiative with Michelle Gillen and Tom Padberg, said lawyers for the authors plan to file a request this week to overturn Orange County Superior Court Judge Tam Nomoto-Schumann’s decision.

If an appeals judge grants the request, it could allow the measure to appear on November’s ballot.

If approved, the initiative would ban residential development in the city until Avenida la Pata in east San Clemente can be extended to Ortega Highway in an unincorporated area east of San Juan Capistrano.
