A developer is suing the city for $2.5 million, saying officials had no basis for denying its proposals for a Wienerschnitzel drive-through restaurant on Chapman Avenue.
The lawsuit, filed June 15 in Orange County Superior Court, says the city unconstitutionally denied BZR Inc. its vested property rights to develop its land at Chapman Avenue and Murray Street.
Two proposals were submitted by the developer and supported by the city’s Planning Commission, but both were denied by the City Council on appeal.
City Administrator Robert D’Amato said the city would handle the lawsuit just like any other. “We will process it, analyze it and, if need be, defend it,” he said.
