Hearing Delayed in Challenge to Provisions of Anti-Airport Measure

A Los Angeles County judge has postponed until July 7 a hearing on the fate of Measure F, the anti-El Toro airport initiative passed in March. Judge S. James Otero was scheduled to consider arguments by airport foes and proponents Friday before ruling on a challenge to the ballot measure.

Attorneys for Orange County have asked Otero to invalidate a section of the measure that limits the Board of Supervisors’ ability to spend money on an airport project.

Airport advocates asked the judge to throw out the entire measure, contending that it violates state laws and the state Constitution. Airport foes have defended the measure, which calls for a two-thirds countywide vote before airports, large jails near homes and hazardous-waste landfills can be built.

Measure F passed March 7 with 67% of the vote.
