A lawsuit by a Denver developer challenging the San Dimas zoning laws that limit development in the northern foothills goes to trial Monday in Los Angeles County Superior Court.
Judge Judith Ashmann will decide whether the city’s zoning laws are so prohibitive that the developer cannot afford to build single-family homes, effectively taking the property without condemning it.
The lawsuit also alleged that San Dimas has deprived the developer, NJD Ltd., of its civil rights partly because the city refused to accept an application to build 91 homes.
