Energy Surcharge Fuels Suit

Marriott International Inc., the biggest U.S. hotel operator, and other lodging chains are facing proposed class-action lawsuits brought by guests who claim room surcharges to cover higher energy costs are illegal.

Mark Aston claims he wasn’t told of a $2.50 a night charge for energy when he reserved his room at Marriott’s Marina Beach hotel in Marina del Rey. Aston’s lawsuit seeks refunds, damages and an order barring the surcharges.

Hotel chains such as Bethesda, Md.-based Marriott, Wyndham International Inc. and Starwood Hotels & Resorts Worldwide Inc. began charging from $2 to $3.50 a night at their California hotels when energy costs rose. Hotels barred from passing on electricity costs may see lower profits.

Guests are supposed to be told about the energy surcharge when they make the reservation, said Jennifer Horton, a manager at Marriott’s Marina Beach hotel.
