Earlier Wednesday, the former fugitive was indicted by a Lincoln County grand jury on charges of aggravated murder.

Longo, who had been on the FBI’s most-wanted list before his capture in Mexico on Jan. 13, is accused of murdering his wife, MaryJane, 34, and children Zachery, 4, Sadie Ann, 3, and Madison, 2.

Longo, who turned 28 on Wednesday, did not appear in court, but he took part in the hearing via closed-circuit television.

Chief Deputy Dist. Atty. Paulette Sanders told the court she would seek the death penalty.

Judge Robert Huckleberry set March 6 as the date for a trial report, when discovery evidence will be presented. Longo has not yet entered a plea.
