New Trial Is Planned in Oxnard Death
A man whose murder conviction was overturned by a federal appeals court will be retried in the 1995 killing of a 30-year-old Oxnard woman, a prosecutor said this week.
In March, the U.S. 9th Circuit Court of Appeals overturned the conviction of Frederick Lee Jackson, finding that he had not been advised of his Miranda rights. Jackson, 35, remains imprisoned at Centinela State Prison in Imperial on a related rape conviction.
After the same appeals court declined to rehear the case and state prosecutors opted against appealing to a higher court, Ventura County Chief Deputy Dist. Atty. Patricia Murphy said her office decided to retry Jackson.
New charges will be filed when Jackson is returned to Ventura County Jail in several weeks, Murphy said.
“He’s dangerous and needs to be punished for his behavior,” Murphy said.
Jackson had been convicted in the rape and murder of Genoveva Gonzales, a mother of four.
