Chiron Settles Suit Over Inhaled Drug

Emeryville, Calif.-based Chiron Corp. said it reached a settlement with Respiratory Disease Network, a group of pharmacies owned by SourceCF Inc., over a version of Chiron’s antibiotic tobramycin for use in an inhaler.
The settlement requires the pharmacies to attach a disclaimer to their formulation, saying it’s not approved by the Food and Drug Administration, the company said. No financial terms were disclosed.

* The Justice Department asked a federal appeals court to reconsider a ruling by a three-judge panel that barred the government from seeking $280 billion in past profits from cigarette makers. The department filed a motion with the U.S. District Court of Appeals for the D.C. Circuit, asking the full court to review last month’s decision.
