Board to No Longer Seek Disclosure Advice

Driven by a court ruling, a state agency has ended its 30-year practice of allowing the subjects of Freedom of Information Act requests to help decide what records should be released.

The Racing and Wagering Board repealed the rule, which a state Supreme Court judge had struck down.

The court case stemmed from the Daily Racing Form newspaper’s attempts in 2002 to get records regarding Catskill Regional Off-Track Betting Corp.
