The San Francisco Fire Commission has rejected a proposed city settlement with the family of a Seattle man who fell to his death during a rescue attempt by a city fire lieutenant.

The family of Nick Torrico sued the city last year after fire Lt. Victor Wyrsch tried to grab the 26-year-old man from behind as he sat on the edge of a Nob Hill apartment building rooftop

The city medical examiner found that Torrico died from his four-story fall but did not find any evidence of criminal wrongdoing by Wyrsch.

The city attorney’s office negotiated with Torrico’s parents to come to the undisclosed settlement that the fire commission unanimously rejected Thursday.

The settlement could still be approved by the city’s Board of Supervisors.
