Parking cash-out criteria

Employers are subject to the state’s parking cash-out law if they meet the following criteria:

•Must have 50 or more workers.

•Must lease, not own, the free parking spaces given to employees.

•Must be able to calculate the cost of the parking subsidies they provide.

•The number of parking spaces can be reduced without penalty under any lease agreement.

•Workplaces must be in an air basin that does not meet state air quality standards.

Employee criteria for eligibility:

•Is or could be using a free or subsidized parking space.

•If free parking is offered and turned down but the space is still available to that worker.

•The employee’s parking space is not reserved for van pools or car pools.
