The Alhambra City Council has voted unanimously to contribute $2,000 to the National Institute of Municipal Law Officers to support a proposed lawsuit challenging the application of the Federal Labor Standards Act to states and municipalities.
If the lawsuit is filed, the institute, an organization of city attorneys, is expected to argue that a U.S. Supreme Court decision requiring cities and states to apply federal requirements for overtime pay to firefighters and police officers infringes on state sovereignty, City Manager Kevin Murphy said.
Compliance with the federal act would cost Alhambra $400,000 the first year, Murphy said, adding that expenditures for the police and fire departments take up more than two-thirds of the city’s annual general fund budget.
The lawsuit is considered an alternative to proposed legislation seeking to exempt firefighters and police officers from the federal Labor Act, Murphy said.
