The State : Rapist Faces 2nd Charge
A paroled rapist was charged with sexually assaulting a 65-year-old woman six hours after his release from Vacaville state prison. David Montgomery, 30, was released at 10 a.m. on Oct. 12 and took a bus to Oakland, where he is accused of raping the woman at 4:10 p.m., police Sgt. Greg Hughes said. He had been sentenced for a 1979 rape that took place next door to the apartment building where the alleged second rape occurred. Hughes said the victim and four of five witnesses picked Montgomery out of a police lineup. Corrections Department spokesman Les Johnson said that prison and parole officials worked out a plan for Montgomery to visit an out-patient clinic. “. . . He was on prescribed medication. He was getting psychiatric treatment. . . . We knew he had some problems; we thought he was in remission. We had no choice but to release him when we did. We thought we had provided for them (the problems).”
