The Region : Suit in Sniper Death of Child Dismissed

A wrongful death suit filed by the father of an 11-year-old girl killed last February when a sniper sprayed the 49th Street Elementary School playground with gunfire has been dismissed in Los Angeles Superior Court. The position of the Los Angeles Unified School District was sustained on the grounds that Eddie Eubanks had not filed a government tort claim as required prior to filing the lawsuit. Eubanks contended in his suit that school officials had heard gunshots coming from the home of the sniper weeks before the attack and had failed to warn him or his daughter, Shala Eubanks, of the danger. A separate wrongful death suit, filed by the victim’s mother, Sandra Jenkins, is pending in Los Angeles Superior Court.
