American Civil Liberties Union attorneys petitioned the U.S. Supreme Court to lift a gag order imposed on both sides in the spy case against former FBI Agent Richard W. Miller. Miller is facing a Feb. 13 retrial in Los Angeles federal court after his first trial ended in November with a deadlocked jury. ACLU attorney Douglas Mirell said that although the U.S. 9th Circuit Court of Appeals issued an opinion that prompted U.S. District Judge David V. Kenyon Jr. to limit his gag order, “in our view it is still too broad and “imposes a substantial restraint, not only on the lawyers themselves . . . but also on the press and public, which are denied the right of access.”
