A North Hollywood man who threatened to kill his former girlfriend in Burbank on Tuesday was shot in the face by her father, then arrested when he sought medical treatment, Burbank police said.

Terry L. Hayes, 29, was in satisfactory condition in County-USC Medical Center jail ward, where he was held on suspicion of attempted murder after being treated at St. Joseph Medical Center in Burbank, authorities said.

Hayes had argued Monday night with his former girlfriend, Gayle Miller, 27, who had recently moved in with her parents on the 1400 block of Pepper Street, Sgt. Scott Wilson said.

Wilson said Hayes left but returned about 7 a.m. Tuesday, banging on a back door and yelling: “I’m going to come in and kill you.” Hayes then broke a window and was reaching through when the woman’s father, Richard Miller, 57, shot the man once in the face with a .32-caliber revolver, police said.

Hayes left in his pickup truck but was arrested when he sought help at St. Joseph.

Police found two knives on Hayes at the hospital and two more in his pickup, Wilson said.

Police said Richard Miller will not be charged in the incident.
