False advertising rules under the California State Business and Professions Code do not apply to political campaigns, the 5th District State Court of Appeal ruled in the case of Assemblyman Phillip D. Wyman (R-Tehachapi), who sued his 1984 Democratic opponent. Wyman charged that Lucinda O’Connor’s consulting firm, B.A.D. of Los Angeles, fabricated quotes critical of him and attributed them to prominent political figures in a mailer. But the appellate court ruled in Fresno that courts should not be “in the business of determining the fairness and unfairness of statements made in a political campaign.”
