The American propensity to sue, fueling a litigation explosion in the 1980s, is just another “in a long line” of myths about the court system, a research study showed. In fact, the number of court cases has decreased from 1981 to 1984, said Robert Roper, director of court statistics at the National Center for State Courts in Williamsburg, Va. The study was to be published in the National Law Journal today. “We found the best explanation for increase in new civil filings in state courts was the population increase,” Roper said in a telephone interview.
