The owner of two adult bookstores pleaded guilty Monday to possessing obscene material for sale.

Donald Wiener, 49, operator of the Video Exchange in Lemon Grove and of Chuck’s Books in National City, will be sentenced Aug. 12.

San Diego Superior Court Judge J. Richard Haden said Wiener could receive a year in jail and that he would consider community service, a fine and weekends in jail as the sentence.

Wiener’s son, Steven Wiener, 25, who also operated one of the stores, and three clerks each pleaded guilty to disturbing the peace.

Steven Wiener and clerks Henry Walter Wilcox, 69; John Richard Shawkey, 57, and Charles Smith, 57, pleaded guilty through their Beverly Hills attorney, Norman Atkins, and were not present in court.

San Diego Municipal Court Judge William Mudd placed the clerks and Steven Wiener on three years’ probation and imposed no jail time. Steven Wiener was fined $300 and the clerks were fined $150 each.

The case brought an unusual display of evidence in February when Judge Patricia Cowett had to watch 3 1/2 days’ worth of X-rated videotape.

Deputy Dist. Atty. Tom Stahl said these movies went beyond legal X-rated films.
