An Oceanside man accused of killing two men in a drinking-related accident will stand trial for second-degree murder in what will be a precedent-setting case in North County, officials said.

Rudy Martinez, 20, faces eight criminal charges, including two murder counts, in connection with a Feb. 7 drunk driving accident that caused the deaths of Daniel Patrick McAllister and David Wolf.

Martinez was ordered to stand trial by Municipal Court Judge William Draper.

Deputy Dist. Atty. Linda Forrest said she was pleased by Draper’s decision, citing Martinez’s “recklessness” as the reason two second-degree murder counts were imposed against him.

Martinez was allegedly drag racing while driving under the influence of alcohol when he lost control of his car and struck McAllister and Wolf near a Cardiff restaurant.

Along with the two murder counts, Martinez faces two counts each of gross vehicular manslaughter while intoxicated, driving under the influence of alcohol and causing injury, and driving under the influence and causing death, Forrest said.

McAllister, 19, of San Diego, and Wolf, 25, of La Jolla, died the day after the crash.

Martinez is scheduled to be arraigned in Vista Superior Court on April 15.

He is being held in County Jail in Vista in lieu of $50,000 bail.
